Welcome to PALLAMERA. These Terms of Service govern your access to and use of our website, products, services, and any purchases made through our online store.

This website is operated by PALLAMERA ATELIER LLC, a Wyoming limited liability company doing business as PALLAMERA. Throughout these Terms, the words “PALLAMERA,” “we,” “us,” and “our” refer to PALLAMERA ATELIER LLC.

By visiting our website, creating an account, placing an order, or purchasing from us, you agree to be bound by these Terms of Service, together with our Shipping & Delivery Policy, Return & Refund Policy, Privacy Policy, and any other policies published on our website.

If you do not agree to these Terms, please do not use our website or purchase our products.

1. Eligibility and Legal Capacity

You may use this website and place an order only if you have the legal capacity to enter into a binding agreement in your place of residence.

If you are under the legal age of majority, you may use this website only with the involvement and permission of a parent or legal guardian.

By placing an order, you confirm that the information you provide is accurate, that you are authorized to use the selected payment method, and that your purchase complies with applicable law.

2. Personal and Business Customers

PALLAMERA products may be purchased by individuals, interior designers, decorators, businesses, hospitality professionals, and other commercial customers.

Unless a separate written agreement has been signed, all purchases remain subject to these Terms of Service, including purchases made for business or commercial purposes.

3. Products and Made-to-Order Production

PALLAMERA specializes in decorative pillows and related home décor products. Most products are made especially for the customer after an order is placed.

Because our products are made to order, production may begin shortly after payment is confirmed. Customers should carefully review the selected design, size, quantity, product details, shipping address, and other order information before completing checkout.

Product availability, materials, manufacturing methods, packaging, and fulfillment locations may change when reasonably necessary without materially reducing the quality of the product purchased.

4. Product Images and Color Representation

We make every reasonable effort to present product photographs, artwork, dimensions, colors, textures, and descriptions accurately.

However, the appearance of colors may vary depending on screen settings, lighting, device type, fabric texture, production method, and other conditions. Minor variations that are normal to printing and manufacturing are not necessarily considered defects.

Product images may include styled interiors, decorative accessories, or lifestyle settings for presentation purposes. Only the items specifically identified in the product description are included with the purchase.

5. Product Measurements

Product dimensions are provided as accurately as reasonably possible. Because textiles and filled decorative products may naturally compress, expand, or vary slightly during production, minor measurement differences may occur.

Customers are responsible for reviewing the dimensions and product information before placing an order.

6. Prices and Currency

Unless otherwise stated, prices displayed on our website are shown in United States Dollars (USD).

Prices may be changed at any time without prior notice. A price change will not affect an order that has already been accepted and paid, except when correction is required because of an obvious pricing or technical error.

Prices may exclude shipping charges, sales tax, customs duties, import taxes, currency conversion charges, or other fees unless expressly stated otherwise. Applicable charges will be displayed during checkout when they can be calculated.

7. Promotions, Discounts, and Promotional Codes

Promotions, discounts, free-shipping offers, and promotional codes may be subject to separate conditions, eligibility requirements, expiration dates, product exclusions, minimum purchase amounts, or geographic restrictions.

Unless expressly stated otherwise:

• Only one promotional code may be used per order.
• Promotions cannot be applied retroactively to completed purchases.
• Promotional offers have no cash value.
• Discounts may not be combined with other offers.
• We may modify or end a promotion at any time before an order is placed.

8. Orders and Order Acceptance

Submitting an order does not automatically mean that it has been accepted. An order is generally accepted after payment has been authorized and an order confirmation has been issued.

We reserve the right to refuse, limit, hold, or cancel an order when reasonably necessary, including in cases involving:

• Suspected fraud or unauthorized payment activity.
• Incorrect pricing, product information, or technical errors.
• Product or material unavailability.
• Unusually large quantities intended for unauthorized resale.
• Incomplete, inaccurate, or unverifiable customer information.
• Orders that may violate applicable law or these Terms.
• Activity that may harm PALLAMERA, our customers, or our service providers.

If we cancel a paid order before fulfillment, we will issue a refund for the cancelled product or order to the original payment method.

9. Order Cancellation Window

Customers may request cancellation within one hour of placing the order.

The message should include the customer’s full name, order number, and the email address used during checkout.

After the one-hour cancellation period has passed, or after production has started, the order may no longer be cancelled because the product is being made specifically for the customer.

A request is not considered completed until it has been reviewed and confirmed by PALLAMERA.

10. Order Changes

Requests to change a design, size, quantity, shipping address, or other order information must be submitted within one hour of placing the order.

We will make reasonable efforts to accommodate timely requests, but changes cannot be guaranteed after production or fulfillment has begun.

Customers are responsible for reviewing all order information before payment.

11. Payment

Payment must be completed using one of the payment methods displayed at checkout. Available payment methods may vary depending on location, device, currency, payment provider, or store configuration.

Payments may be processed by Shopify Payments or other authorized third-party payment providers. PALLAMERA does not directly store complete payment-card information.

By submitting payment information, you represent that:

• You are authorized to use the selected payment method.
• The billing information provided is complete and accurate.
• You authorize the applicable charges for your order.

Production will not begin until payment has been successfully authorized or confirmed.

12. Taxes

Applicable sales tax may be calculated and collected during checkout based on the order, delivery destination, and applicable tax requirements.

Customers purchasing on behalf of a tax-exempt organization or business are responsible for providing any required documentation before completing the purchase when tax-exempt purchasing is supported.

13. Shipping and Delivery

Production schedules, shipping methods, estimated delivery times, tracking, address requirements, international customs, and delivery issues are governed by our Shipping & Delivery Policy.

Delivery dates are estimates unless expressly guaranteed in writing. Carrier delays, customs processing, severe weather, service interruptions, and other circumstances outside our reasonable control may affect delivery.

When an order contains multiple products, items may be shipped together or in separate packages depending on production location, availability, packaging, and carrier requirements.

14. Failure to Ship Within the Estimated Time

If we are unable to ship an order within the stated or reasonably expected time, we may contact the customer with a revised estimate and, where required by applicable law, provide the opportunity to accept the delay or cancel the affected unshipped item for a refund.

15. Returns, Replacements, and Refunds

Returns, replacements, reprints, refunds, damaged orders, incorrect products, defective products, and other post-delivery issues are governed by our Return & Refund Policy.

Because our products are made to order, we generally do not accept returns or exchanges for change of mind, incorrect size selection, personal preference, or décor incompatibility.

This does not affect rights that cannot legally be excluded under applicable consumer-protection law.

16. Customer Accounts

Certain website features may allow customers to create an account. You are responsible for maintaining the confidentiality of your login details and for activity conducted through your account.

Please notify us promptly if you believe your account has been accessed without authorization.

We may suspend or close an account when reasonably necessary to prevent fraud, abuse, unauthorized activity, security risks, or violations of these Terms.

17. Wholesale and Trade Inquiries

Wholesale, trade, hospitality, interior-design, and other volume purchasing opportunities may be available upon request.

Wholesale pricing, minimum quantities, production schedules, payment terms, shipping arrangements, permitted resale channels, and other conditions must be approved by PALLAMERA in writing.

Submitting an inquiry does not guarantee wholesale approval or availability.

18. Resale Restrictions

Purchasing a PALLAMERA product does not grant permission to reproduce its design, manufacture copies, create derivative products, or use our artwork for another commercial purpose.

Products may not be resold as authorized PALLAMERA merchandise without our prior written approval, except where resale rights cannot legally be restricted.

Approved wholesale customers remain subject to their separate written wholesale or trade agreement.

19. Intellectual Property

All content displayed through the PALLAMERA website and brand, including but not limited to artwork, illustrations, patterns, decorative designs, product designs, photographs, mockups, videos, graphics, logos, icons, text, collection names, page layouts, branding, and other creative material, is owned by or licensed to PALLAMERA ATELIER LLC and is protected by applicable intellectual-property laws.

No purchase transfers ownership of any artwork, design, copyright, trademark, brand asset, digital file, or other intellectual property.

Without prior written permission from PALLAMERA ATELIER LLC, you may not:

• Copy, reproduce, trace, redraw, scan, download, or extract our designs.
• Modify, recolor, adapt, or create derivative works from our artwork.
• Print our artwork on pillows, textiles, clothing, posters, accessories, or other products.
• Use our photographs, videos, descriptions, or graphics in another store or marketplace.
• Sell, license, distribute, upload, or share our designs or digital files.
• Use PALLAMERA branding in a way that suggests authorization, sponsorship, or affiliation.
• Use automated tools to collect or reproduce substantial portions of our website.

Unauthorized use may result in account restrictions, order cancellation, takedown requests, or other remedies available under applicable law.

20. Trademarks

The PALLAMERA name, logo, visual identity, slogans, collection branding, and related brand elements may be trademarks or trade dress belonging to PALLAMERA ATELIER LLC.

Nothing on this website grants a license to use our trademarks without prior written authorization.

21. Customer Reviews and Submitted Content

Customers may be able to submit reviews, photographs, comments, messages, or other content.

You retain ownership of content you submit, but you grant PALLAMERA a non-exclusive, worldwide, royalty-free license to display, reproduce, format, and share that content for operating and promoting our business, subject to applicable privacy and consumer-protection laws.

Nothing in this section prevents either party from exercising rights or seeking remedies that cannot legally be restricted.

Failure by PALLAMERA to enforce a provision of these Terms does not waive our right to enforce that provision or any other provision later.

PALLAMERA may transfer its rights and obligations in connection with a merger, acquisition, restructuring, sale of assets, or other lawful business transaction, subject to applicable law.
